1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the MazikMail mobile application (the "App") and the services provided therein. The App is operated by Myolisi Prince Masuku ("we," "us," or "our"), a sole proprietor based in South Africa. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Services Overview
MazikMail is an all-in-one platform for music promotion and discovery.
Our services include:
Music Submission Hub: Allowing Artists to send music, press kits, and emails to a database of media contacts.
Streaming & Listener Earnings: Allowing users ("Listeners") to stream music and earn virtual tokens.
Fan-Driven Charts: Allowing users to vote on music charts using tokens.
Artist Toolbox: Providing educational resources for music professionals.
3. Accounts and Registration
To use certain features, you must provide a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must be at least 13 years old to use the App. If you are under 18, you represent that you have obtained parental consent.
4. Subscriptions and Payments (Auto-Renewable)
MazikMail offers auto-renewable subscription plans for Artists (Monthly at R179.99 and Yearly at R1,999.99).
Billing: Payment will be charged to your Apple ID and Google account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.
Management: You can manage and turn off auto-renewal by going to your Account Settings on the App Store after purchase.
Free Trial: Any unused portion of a free trial period will be forfeited when you purchase a subscription.
5. In-App Purchases (Consumables)
The App offers consumable items:
Tokens: Purchased for R49.99 per bundle (50 tokens) to vote on charts.
Submissions: Purchased for R29.99 per media submission to send campaigns.
These are non-refundable and non-transferable.
6. Listener Earnings and Stream Tokens
Listeners earn "Stream Tokens" based on a tiered system for playing tracks. These tokens have no real-world value outside the App. Once a minimum threshold is reached, Stream Tokens can be converted into "Voting Tokens" or potentially other benefits within the App. We reserve the right to modify the earning rates or conversion mechanics at any time.
7. User Content and Conduct
You are solely responsible for the content you submit (e.g., music files, images, text).
Ownership: You retain all rights to your content. By submitting it, you grant us a license to host and distribute it for the purpose of operating the service.
Prohibited Conduct: You agree not to use the App to infringe on copyrights, send spam, distribute malware, or harass others.
Copyright Infringement: We will respond to notices of alleged copyright infringement. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us at mazikmail@mazikmail.co.za.
8. Disclaimer
You acknowledge that these Terms are between you and MazikMail, not Apple or Google. Apple and Google are not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Google, and Apple and Google will refund the purchase price (if any); to the maximum extent permitted by law, Apple and Google will have no other warranty obligation whatsoever with respect to the App.
9. Limitation of Liability
To the fullest extent permitted by applicable law (including the Consumer Protection Act, 2008, in South Africa), MazikMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
11. Changes to Terms
We may revise these Terms from time to time. If we make changes, we will post the revised Terms within the App. By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms.
